Why does leasehold conveyancing involve extra work?

Your conveyancer checks the lease as well as the property title. They consider the remaining term, ground rent, service charges, restrictions and any consents needed for the transfer. Information from the landlord or managing agent helps them understand how the building is managed.

This is why a leasehold quotation can differ from a freehold quotation. The work included should be set out clearly; a lease extension or a deed change may need a separate scope and price.

Buying a leasehold property

Before you commit, ask your conveyancer to explain the lease and any obligations that will pass to you.

  • Lease and lender requirements: remaining term and relevant lease provisions.
  • Running costs: service-charge accounts, ground rent and planned works information.
  • Transfer requirements: any notices, consents, deed of covenant or certificate needed.
  • Building information: tell your conveyancer about issues such as major works or building-safety requirements.

Selling? Ask about the management pack early

The buyer’s conveyancer will usually need management information, often supplied using the LPE1 form with supporting documents. It can cover accounts, insurance, service charges and planned works. Your conveyancer can tell you who needs to provide it.

Ask the landlord or managing agent about their fee and expected turnaround early. More than one organisation may need to provide information. Paying for a pack does not guarantee how quickly they will respond.

Visit LEASE for independent leasehold information.

Which charges should you check?

Charge What to establish
Leasehold legal work Whether the quoted legal fee includes the leasehold work for your transaction.
Management information Who supplies the pack, its fee and any separate charges for additional replies.
Notices and consents Whether landlord or managing-agent fees apply on transfer or mortgage.
Extra legal work Any separate cost for a lease extension, deed variation or other work outside the quoted scope.

These fees depend on the lease and the organisations involved. Avoid treating a headline quote as confirmation that every third-party charge is included.

How to compare leasehold conveyancing quotes

A lower headline legal fee is not enough to compare two leasehold quotes. Check that each covers the same property, mortgage and legal work, then compare the total including VAT.

  1. Describe the property: give the price, postcode, leasehold tenure and number of buyers. Tell us if it is a new build or shared ownership.
  2. Identify the legal work: check the leasehold supplement, mortgage work and any work relating to building safety or an unusual lease.
  3. Separate outside charges: ask which management-pack, notice, consent or deed charges are known and which remain to be confirmed.
  4. Check your upfront payment: establish what it covers, whether it is included in the quoted total and what happens if the move falls through.

Buying and selling a leasehold property?

Tell us the tenure of each property separately. Your sale may need a management pack, while your purchase needs a lease review and may carry transfer-related charges. These are different costs; a combined quote should distinguish both transactions.

Your questions, answered

Can I get a quote for a leasehold flat?

Yes. Choose your transaction and select leasehold in the quote form. Enter the property details accurately so the quotation reflects your move.

Is a share-of-freehold flat still leasehold?

It can be. Owning a share of the freehold does not automatically remove the individual flat’s lease. Tell your conveyancer both facts so they can confirm the work required.

Is the management pack included in my legal fee?

Check the quotation. A landlord or managing agent’s management-pack charge is separate from the conveyancer’s legal fee and may be payable in addition.

Can you guarantee a leasehold completion date?

A quote is not a completion guarantee. Timing depends on the legal work, other parties, lender requirements and information being supplied. Tell us about any proposed deadline when you call.
